Título : Análisis jurídico y doctrinario de la sentencia N. º002-16-SCN-CC y la posible vulneración a los derechos de los alimentados

Resumen : Este trabajo analiza la sentencia N. º002-16-SCN-CC emitida por la Corte Constitucional del Ecuador, misma que inicio como una consulta de constitucionalidad del articulo innumerado 16 numeral 2 del código de la niñez y adolescencia, específicamente sobre las pensiones adicionales que deben suministrar los alimentantes a los alimentados, dichas pensiones que coinciden con la decimotercera y decimocuarta remuneración que perciben los trabajadores. La indagación que a continuación se presenta tiene como objeto analizar esta sentencia y determinar si puede o no vulnerar los derechos de los niños, niñas y adolescentes ocasionados por una limitada interpretación de los jueces constitucionales, además determinar si han hecho una correcta interpretación sobre el interés superior del niño. Es una investigación jurídica mixta, de corte cualitativa, descriptiva, donde se trabajó con 10 jueces que conforman la Unidad Judicial de la Familia, Mujer, Niñez y Adolescencia del cantón Riobamba. Los resultados indican que la resolución de la sentencia vulnera ciertos derechos de los niños tales como el de igualdad, proporcionalidad y una vida digna, puesto que los jueces han emitido su sentencia en base a la confrontación de derechos entre los niños y los alimentantes, mas no han ponderado derechos entre los mismos menores.
Descripción : This work analyzes the sentence No. 002-16-SCN-CC issued by the Constitutional Court of Ecuador. It started as a constitutional poll of the unnumbered article 16, number 2 about Childhood and Adolescence Code; specifically on the additional payments. That is to say the supply administration from the feeder to the eater. Those payments must agree with the thirteenth and fourteenth salary received by the workers. The following poll analyzes the employed judgment in order to determine whether or not it violates the rights of children and adolescents, which is usually caused by a limited interpretation by some constitutional judges. It also determines whether they have made a correct interpretation of the superior interest superior of the child. It is a mixed legal investigation, qualitative, descriptive. There were 10 judges, as participants, who come from Family, Women, Children and Adolescents Judicial Unit in Riobamba canton. The results indicate that the resolution of that sentence violates certain children's rights such as equality, proportionality and a dignified life, since the judges have issued their sentence based on the confrontation of rights between children and supporters, but they have not weighted rights among the same minors.
