Resumen : El presente proyecto de investigación denominado “LOS PRINCIPIOS DE SUPREMACÍA CONSTITUCIONAL EN LAS SENTENCIAS NO.11-18CN/19 DICTADAS POR LA CORTE CONSTITUCIONAL DEL ECUADOR, REFERENTE AL MATRIMONIO IGUALITARIO.” Basa su línea investigativa a Garantías Constitucionales. Los principios de supremacía constitucional representan la columna vertebral de la normativa suprema de los estados. La supremacía constitucional en su espíritu, está constituida por dos corrientes, la primera es la formalidad, aquella otorga fuerza y exigibilidad de las normas. La segunda vertiente es la que forma parte de los sistemas garantistas de derechos, también llamada material, donde existe el bloque de constitucionalidad, control de convencionalidad y control constitucional de las normas de los estados. Corrientes que son desarrolladas en el contenido de las sentencias que serán analizadas en esta investigación. La Corte Constitucional del Ecuador, es el máximo órgano de control, interpretación constitucional y de administración de justicia en esta materia y como una de las atribuciones que por mandato expreso de la norma suprema tiene es la de absolver consultas de norma, en caso de que un juez considere que un precepto jurídico es contrario a la Constitución o a los Instrumentos Internacionales de Derechos Humanos. El presente proyecto de investigación analizará una consulta de norma que desembocó en la sentencia No. 11-18-CN/19 y No.10-18-CN/19 resuelta por la Corte Constitucional en el año 2019. La investigación busca obtener como resultado, conocer cual, de las sentencias emitidas por los jueces Constitucionales, se adapta a los principios de Supremacía Constitucional que mandan los artículos 424-428 de la Constitución.
Descripción : This research project called "THE PRINCIPLES OF CONSTITUTIONAL SUPREMACY IN JUDGMENTS NO.11-18CN/19 DELIVERED BY THE CONSTITUTIONAL COURT OF ECUADOR, CONCERNING THE EQUAL MARRIAGE." It bases its research line on Constitutional Guarantees. The principles of constitutional supremacy represent the backbone of the supreme regulations of the states. The constitutional supremacy in its spirit is made up of two tendencies, the first is a formality, that one grants force and enforceability of the norms. The second one is part of the rights guarantee systems, also called material, where there is the constitutionality block, control of conventionality, and constitutional control of state norms. Tendencies that are developed in the content of the sentences that will be analyzed in this research. The Constitutional Court of Ecuador is the highest institution of control, constitutional interpretation and administration of justice in this matter and as one of the attributions that by express mandate of the supreme norm has is to absolve consultations of the norm, in case that a judge considers that a legal precept is contrary to the Constitution or the International Human Rights Instruments. This research project will analyze a standard consultation that led to judgment No. 11-18-CN / 19 and No. 10-18-CN / 19 resolved by the Constitutional Court in 2019. The research seeks, as a result, to know which of the sentences issued by the Constitutional judges is adapted to the principles of Constitutional Supremacy that articles 424-428 of the Ecuadorian Constitution.
