Resumen : La contratación pública en el Ecuador ha sido manejada en los últimos 10 años por el Sistema Nacional de Contratación Pública (SERCOP) instituido en el año 2007 como una herramienta creada por la Ley Orgánica del Sistema Nacional de Contratación Pública (LOSNCP), con el objetivo de manejar de forma eficiente y transparente proceso de contratación de bienes y servicios para él estado, logrando posicionarse como el mejor sistema de contratación a nivel del continente americano. El objetivo de la presente investigación fue identificar las falencias que tiene el sistema, sabiendo que existe un nivel de insatisfacción por parte de los contratistas respecto al SERCOP. El gobierno autónomo descentralizado de municipal de Riobamba (GADMR) celebro procesos de contratación por más de 12 millones de dólares en obras civiles, específicamente en cotizaciones adjudicas mediante el SERCOP. Con esta finalidad se analizó los concursos celebrados en el GADMR en los últimos 9 años, recopilando la información de más de 50 cotizaciones adjudicadas y 320 participantes de los mismos. Los datos fueron recopilados en el portal de compras públicas, al final gracias a estos datos se creó un modelo estadístico que permitió encontrar la fiabilidad de nuestro sistema de contratación. Los resultados de la investigación muestran como una mejor oferta favorece levemente en el resultado del concurso primando esta calificación por sobre otras. Así mismo existen casos en los que la mejor oferta no influye en la adjudicación por razones como la descalificación de oferentes que elimina el propósito de competencia del sistema.
Descripción : Public procurement in Ecuador has been handled in the last 10 years by the National System of Public Procurement (SERCOP) It was instituted as a tool created by the Organic Law of the National System of Public Procurement (LOSNCP) in 2007, It has the objective to manage the process of hiring goods and services for the state efficiently and transparently. In this way, it has achieved to be the best public procurement system in the American continent. The objective of this research was to identify the shortcomings of the system, knowing that there is a level of dissatisfaction on the part of builders about it (SERCOP). The decentralized autonomous municipal government of Riobamba (GADMR) held contracting processes for more than 12 million dollars in civil works, specifically in quotations awarded through the SERCOP. With this purpose, we analyzed the competitions held in the GADMR in the last 9 years, collecting the information of more than 50 quotations awarded and 320 participants of the same. The data was collected in the public procurement portal, at the end thanks to this data, a statistical model was created. It has allowed us to find the reliability of our contracting system. The results of the investigation show how the best offer favors slightly in the result of the contest, prioritizing this rating over others. There are also cases in which the best offer does not influence the award for reasons such as the disqualification of bidders that eliminates the purpose of competition of the system.
