Resumen : Dentro del trabajo de investigación que se titula: “ESTUDIO COMPARATIVO ENTRE LAS GARANTÍAS HIPOTECARIAS Y PRENDARIAS, EN LA LEGISLACIÓN CIVIL ECUATORIANA.” Se ha procurado conocer a profundidad las garantías reales de hipoteca y prenda, por lo cual se investigó a la hipoteca, que básicamente es la constitución de garantía sobre un bien inmueble. Así como también, se estudió la prenda que es la constitución en garantía de un bien mueble. La hipoteca presenta múltiples características que le son propias, desde el momento de su constitución, la misma que se realiza mediante una escritura pública, por tratarse de un derecho real sobre un inmueble, adicionalmente esta debe inscribirse en el Registro de la Propiedad del cantón en el cual se encuentre. Por su parte la prenda, se constituye mediante un contrato privado con reconocimiento de firmas ante un Notario, el cual debe inscribirse en el Registro Mercantil, la prenda puede ser ordinaria, especial de comercio y agrícola, dependiendo del bien mueble del cual se trate. La diferenciación entre ambas garantías reales se centra en el objeto que son muebles e inmuebles, no obstante, existen otras diferencias que fueron estudiadas, como es la forma en la que debe embargarse el bien, ya que la hipoteca solo requiere la inscripción de la providencia del Juez, en tanto que, la prenda requiere el depósito judicial, para evitar su ocultamiento.
Descripción : Within the research work entitled "COMPARATIVE STUDY BETWEEN MORTGAGE AND PREMIUM GUARANTEES, IN ECUADORIAN CIVIL LEGISLATION." We have tried to know in depth the real guarantees of mortgage and pledge, for which we investigated the mortgage, which basically it is the constitution of guarantee on a real estate. As well as, the pledge that is the constitution in guarantee of a movable good was studied. The mortgage has multiple characteristics that are its own, from the moment of its constitution, the same that is done by a public deed, because it is a real right over a property, in addition it must be registered in the Property Registry of the canton in which is found. The pledge, for its part, is constituted by a private contract with signature recognition before a Notary, which must be registered in the Mercantile Registry, the pledge may be ordinary, special trade and agricultural, depending on the movable property in question. The differentiation between the two real guarantees focuses on the object that are movable and immovable, however, there are other differences that were studied, such as the way in which the property should be seized, since the mortgage only requires the inscription of providence of the Judge, while the pledge requires judicial deposit, to avoid concealment.
