| Resumen : | La estructura del presente trabajo de investigación se encuentra dividida en seis capítulos: el primer capítulo trata sobre el Marco Referencial donde se origina el planteamiento del problema, su origen, como se presenta y cómo se comporta el mismo; el objetivo general y los objetivos específicos; la justificación e importancia del problema, donde observamos que el presente trabajo investigativo es factible, novedoso, original que servirá para los abogados, estudiantes de la carrera de derecho y ciudadanía en general. En el segundo capítulo se desarrolla el marco teórico, donde se aplicó el instrumento del fichaje el cual se obtuvo a través de doctrinas, teorías, conceptos y artículos bibliográficos extraídos de códigos, libros, reglamentos, leyes y textos, construyendo la parte teórica, conceptual, legal y doctrinaria de la investigación, este capítulo se encuentra dividida en seis unidades, con sus subunidades; en la primera unidad hablamos acerca de la prescripción extraordinaria adquisitiva de domino; en la segunda unidad hablamos acerca de la prueba en el juicio ordinario de prescripción extraordinaria adquisitiva de domino; en la tercera unidad hablamos acerca de las clases de prueba en el juicio ordinario de prescripción extraordinaria adquisitiva de domino; en la cuarta unidad vemos sobre la inspección judicial en el juicio ordinario de prescripción extraordinaria adquisitiva de domino; en la quinta unidad hablamos acerca del efecto jurídico de la inspección judicial en las sentencia en los trámites ordinarios de prescripción extraordinaria adquisitiva de domino y por último la sexta unidad vemos la unidad hipotética, hipótesis, las variables, operacionalización de las variables. En el tercer capítulo, desarrollamos el marco metodológico, el método analítico a través de las encuestas; así como las entrevistas, se aplicó el método analítico para llegar a realizar un análisis crítico y jurídico para poder verificar la hipótesis planteada. |
| Descripción : | The judicial inspection and its legal effects in the sentences dictated in the ordinary proceedings of extraordinary prescription of domain acquired in the Civil Judicial Unit based in the canton Riobamba during the period January-June 2016. ABSTRACT: The structure of the present research work is divided into six chapters: the first chapter deals with the Referential Framework where the problem originates, its origin, how it is presented and how it behaves; The general objective and the specific objectives; The justification and importance of the problem, where we observe that the present investigative work is feasible, novel, original that will serve for the lawyers, students of the race of right and citizenship in general. In the second chapter the theoretical framework was developed, where the instrument of the transference was applied, which was obtained through doctrines, theories, concepts and bibliographical articles extracted from codes, books, regulations, laws and texts, constructing the theoretical part , Legal and doctrine of research, this chapter is divided into six units, with their subunits; In the first unit we talk about the extraordinary acquisition prescription of domino; In the second unit we speak about the test in the ordinary judgment of extraordinary prescription purchasing domino; In the third unit we talk about the kinds of evidence in the ordinary trial of extraordinary prescription purchasing domino; In the fourth unit we see on the judicial inspection in the ordinary trial of extraordinary prescription purchasing domino; In the fifth unit we talk about the legal effect of judicial inspection in the sentences in the ordinary proceedings of extraordinary prescription purchasing domino and finally the sixth unit we see the hypothetical unit, hypothesis, variables, operationalization of variables. In the second chapter, the theoretical framework was developed, where the instrument of the transference was applied, which was obtained through doctrines, theories, concepts and bibliographical articles extracted from codes, books, regulations, laws and texts, constructing the theoretical part, Conceptual, legal and doctrinaire research, this chapter is divided into six units, with their subunits; In the first unit we talked about the criminal process in traffic offenses; In the second unit about the criminal offense; In the third unit on wrongful traffic offenses; The fourth unit on the transit test, the fifth unit on the incidence of baseline cause in traffic offenses and finally the sixth unit we see the hypothetical unit, hypothesis, variables, operationalization of variables. In the third chapter, we developed the methodological framework, the analytical method through surveys; As well as the interviews, the analytical method was applied to arrive at a critical and legal analysis to verify the hypothesis. In the fourth chapter, the administrative framework; The fifth chapter sets out the conclusions and recommendations; Finally, in the sixth chapter, the bibliography, the supplementary bibliography and annexes are established. |
